Welcome to TuneVote! These Terms of Service (“Terms”) govern your access to and use of the TuneVote web application and related services (the “Service”), operated by TuneVote (“we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 in jurisdictions where 16 is the minimum digital consent age) to use the Service. By using TuneVote you represent that you meet this age requirement and have the legal capacity to agree to these Terms.
2. Acceptable Use
You agree not to:
- Use the Service for any illegal, harmful, or abusive purpose
- Post, suggest or vote for content that infringes copyright, trademarks, or other rights
- Harass, spam, impersonate others, or disrupt sessions
- Attempt to reverse-engineer, scrape, or interfere with the Service
- Use bots, scripts or automated tools to vote or create sessions (except when explicitly allowed)
- Share session links in a way that violates third-party platform rules (e.g. mass-spamming)
3. User Content & Votes
When you suggest songs, vote, name sessions, or otherwise submit content (“User Content”), you grant us a worldwide, non-exclusive, royalty-free license to display, reproduce, distribute, and perform that content solely for operating, promoting, and improving the Service (including showing active sessions and aggregated charts).
You are responsible for the User Content you submit and warrant that it does not violate any laws or third-party rights.
4. Intellectual Property
The Service (design, code, logos, text, graphics) is owned by TuneVote or its licensors and protected by copyright and other laws. You may not copy, modify, distribute or create derivative works without our written permission.
Song metadata, album art and previews displayed are provided via third-party APIs and remain the property of their respective owners.
5. Third-Party Services & Music Data
TuneVote integrates with music metadata providers and may display album art, track previews or links. We do not host or stream music files. Any playback occurs through your own music service/account (Spotify, Apple Music, YouTube, etc.).
Your use of linked third-party services is governed by their own terms and privacy policies.
6. Limitation of Liability
To the fullest extent permitted by law, TuneVote is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
Our total liability shall not exceed CHF 100 (or equivalent).
7. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, especially for violations of these Terms.
8. Changes to Terms
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Continued use after changes constitutes acceptance.
9. Governing Law & Disputes
These Terms are governed by the laws of Switzerland. Any disputes shall be resolved exclusively in the courts of Lucerne, Switzerland.
